Article 1 - ORGANISATION
Garda Dolomiti Azienda per il Turismo S.p.A. (APT or Garda Dolomiti) – VAT No. and Tax Code 01855030225, registered office at Largo Medaglie d'Oro al Valor Militare, 5, 38066 Riva del Garda (TN), Italy, phone number +39 0464 554444, email address amministrazione@gardatrentino.it, and certified email address (PEC) gardatrentino@pec.gardatrentino.it – has as its primary purpose the promotion of the local region’s tourist image in accordance with the provisions of Provincial Law No. 8 of 12 August 2020, entitled “2020 Provincial Tourism Promotion Law”. This is achieved through tourism marketing initiatives and targeted projects aimed at improving the destination’s tourism offerings. These projects focus on preserving the local area’s environmental, cultural, and historical heritage, with the goal of maintaining the quality of the hospitality on offer, enhancing the tourist experience, and fostering customer loyalty.

APT is the creator and organiser of a series of exhibitions and sporting events integrated into a cohesive organisational structure. These events form part of a trade fair/exhibition called Bike Festival Riva del Garda (hereinafter the Festival). The Festival is represented by a unique logo, as depicted below, of which APT is the exclusive owner.



With regard to the Festival’s organisation and management, APT makes use of official organisational, technical and financial partners, whose relations are governed by specific contractual provisions.

The organisational and management framework of Bike Festival Riva del Garda, owned by APT, is founded on the following components:
- unique organisation/management and setting (Riva del Garda - Garda Trentino)
- the ability to bring the entire European biking community together at an appealing hub, with the Festival expo area at its core, where the majority of events take place
- the combination of off-road cycling sports, spanning from the highest competitive tiers to promotional events tailored for young bikers, coupled with the promotion, exhibition, and marketing of all products related to the MTB biking world. This includes leisure and recreational activities that define the type of holiday promoted by the Garda Trentino Brand (“stay young”), defined by mountains and MTB trails, as well as unique views of Lake Garda.

The Festival’s MTB-related sporting events include:
- the Bike Marathon, a Class C1 international cross-country race included in the international calendar, comprising three different types of routes and whose technical-federal aspects are organised by the Trentino Cycling Team 23 ASD
- the Gravel Garda Trentino, an amateur cross-country endurance (ED) sporting event on 100 or 65 km routes, not included in the official FCI- UCI calendar
- the eMTB Challenge, an amateur endurance cross-country (ED) sporting event for eMTB enthusiasts, not included in the official FCI- UCI calendar
- the Junior Trophy sporting event for children aged between 3 and 14 years, not included in the official FCI - UCI calendar

These regulations govern the general aspects linked to Festival planning and administration, describing the organisational and management concept that characterises it. They function as a framework for specific regulations and/or General Contract Clauses (GCCs) designed to govern detailed aspects and/or relationships with partners, suppliers, exhibitors, guests, visitors, athletes, and competitors.

Article 2 - OBJECTIVES
Through the Bike Festival Riva del Garda platform, APT seeks to:
- promote and generate appreciation for the Garda Trentino region, both in Italy and abroad, by showcasing its environment, services, and amenities. This emphasis extends to activities related to the off-road biking world (MTB, eMTB, and Gravel), fostering the understanding and promotion of these sports and the alternative mobility model they represent;
- facilitate financially and mutually beneficial interactions between the industry and the entire MTB community, fostering the development of connected and reciprocal marketing strategies;
- expand business focused on the provision of services to companies who promote the local area

Article 3 - GENERAL INFORMATION
The Bike Festival Riva del Garda is held every year, usually between the end of April and the beginning of May. The official date is specified on bikefestivalriva.com/en, and the exclusive programme of events and exhibitions for the Festival is available for annual consultation at bikefestivalriva.com/en/program. The organiser is not liable for events/exhibitions that do not appear in the official programme.

In the event that the annual edition of the Festival is cancelled due to directives issued by local, state, or international authorities, force majeure, or emergencies (including, but not limited to, situations related to possible pandemics), the individual events constituting the Festival may be partially or entirely cancelled. In such cases, all agreements or contractual obligations on the part of the organiser will be terminated, with considerations given to specific details outlined in individual regulations, contracts, or GCCs.

Even without directives from the competent authorities, APT retains the right to cancel either specific events/exhibitions or the entire Festival. Additionally, APT may implement individual changes/modifications to the official programme based on contingent needs, ensuring the overall success of the Festival and the achievement of the aforementioned objectives.

In any case, the Organiser, possibly in collaboration with its partners, commits to promptly notify concerned parties and participants of any changes. This will be done using the communication tools deemed most effective and timely at the given moment. All communications outlined in these Regulations, of any nature or type, will be deemed valid when posted on the Festival's website (refer to the link below) or sent to the email addresses provided by participants in the registration form. Participants are required to regularly check the Festival website, and the Organiser declines all responsibility for delays, misunderstandings, or lack of electronic communication.

Article 4 - VENUES AND RULES OF CONDUCT
4.1 Main Venue
The main Festival venue is the Expo Area situated in Viale Rovereto in Riva del Garda. This charming location can host a substantial number of visitors, and the arrangement of spaces and facilities is shown on the map available for download here .

The Expo Area is open to the public as follows:

Friday: 10am - 7pm
Saturday: 10am - 10pm /Open Night 6pm - 10pm
Sunday: 10am - 4pm

Exhibitors will be able to access the area.
It is strictly forbidden to enter the Expo Area when it is closed. Trespassers will be reported to the Judicial Authorities pursuant to Article 614 of the Italian Criminal Code.

Article 5 - PARTICIPATION MODES
To participate in the Festival and gain entry to the Expo Area and other designated venues, registration is required. Participants must acquire a PASS and use the designated entrance gates for access. Registration can be completed using the procedure outlined here, following the instructions provided at bikefestivalriva.com/en/expo/expo-visitor-registration


The following access pass categories are available:
• Visitors
• Exhibitors
• Press
• VIP
• Crew

Passes are non-transferable. Passes are checked at the entrance and within individual areas. Those in breach of the rules or found to be without a pass authorising their presence will be removed.

The following rules apply in the Expo Area:
- No littering. Use the bins provided in the dedicated spaces and areas;
- The following rules are mandatory:
1. follow signs and floor/wall markings;
2. push bikes inside the Expo Area at a walking pace; always make sure to give way to pedestrians;
3. behave respectfully towards members of the public, exhibitors, and staff;
4. respect the closing times provided by the organisation;
5. always follow the instructions provided by marshals and service personnel on the roads and within the festival grounds.

Throughout the entire Festival, participants are required to exhibit proper and respectful conduct, refraining from causing harm to themselves and/or infringing upon the rights of others in any manner.

By registering for entry to the Expo Area, participants acknowledge and accept these Regulations, which are also available in Italian and German on the official Festival website. In cases of interpretation issues, the Regulations in the Italian language will be deemed valid for all purposes. Italian law applies. The Court of Rovereto (TN) shall have exclusive jurisdiction for any disputes, excluding any other optional court.

Testing activities, trials, and the use of bikes, materials, clothing, and tools for any reason are undertaken at the users' own risk. Users declare their waiver of any claims, including the right to sue, against the Organiser, as the Organiser's role is strictly limited to providing the relevant areas and is entirely unrelated to these activities.

Article 6 – SPORTING EVENTS
6.1. The Festival’s official sporting events
The Festival’s official sporting events are subject to these general regulations, special individual race regulations, and the technical regulations issued by the FCI (Italian Cycling Federation) and UCI (International Cycling Union), as applicable. Specific attention, particularly concerning definitions, should be paid to the ITALIAN CYCLING FEDERATION’S “IMPLEMENTING REGULATIONS 2024 - INTERNATIONAL/NATIONAL/REGIONAL MOUNTAINBIKE ACTIVITIES” (available here).

The technical organiser of the Bike Marathon (race class C1 Int. XCM included in the UCI 2024 International and National Race Calendar, available for consultation here) is the TRENTINO CYCLING TEAM U23. Website: trentinocyclingteam.it, FCI Code 20P1219, address: VIA TONALE 23 - 38010 - SAN MICHELE ALL'ADIGE - TN, telephone: 0461650134, fax: 0461650134, email: tctu23@virgilio.it. The TRENTINO CYCLING TEAM U23 will appoint a DOF - OFF-ROAD RACE ORGANISER in accordance with the provisions of the FCI’s IMPLEMENTING REGULATIONS FOR 2024. The DOF, under his or her sole responsibility, will draft/prepare the Technical Guidelines/Race Safety Plan and oversee the activities of collaborators and signallers to ensure the safety of racers and spectators during competitions and official training.

The other races (Gravel Garda Trentino, eMTB Challenge, and Junior Trophy) are directly organised by Garda Dolomiti Azienda per il Turismo S.p.A. Garda Dolomiti Azienda per il Turismo S.p.A. will designate a DOF and a Technical Delegate responsible for handling the necessary technical organisational tasks. This will be done in accordance with the provisions outlined in the individual special race regulations and the federal technical regulations (e.g., FCI 2024 E-MOUNTAIN BIKE REGULATIONS - format Enduro Classe M, Gravel Regulations, standards) as explicitly referenced.

6.4 Audience Behaviour
Access to the circuits where the sporting events take place, excluding the finish and starting areas, is not restricted (with potential restrictions set by owners of private areas) and is at the spectators' own risk.

While participating in the Festival, especially during events and side activities and exhibitions within the Expo Area or Additional Venues, participants must follow the organisational and safety regulations issued by the Organiser or its partners. Participants are prohibited from displaying behaviours or wearing attire that goes against the principles of public decency and good taste or violates laws or the rights of third parties. Homophobic, racist attitudes, or the glorification of one or more warring parties are strictly forbidden. Offenders will be promptly removed.

During events and sporting competitions within the Expo Area or Additional Venues, the audience must stand in the designated reserved spaces. Obstructing the movement of athletes/competitors in any way is prohibited.

Anyone who, in the course of a sporting event, attempts to harm the performance of one or more competitors by placing stones, nails, or other obstacles on the competition route or uses fake signals or any other interference or disturbance system, will be deemed to have committed a violent act, even if the conduct is only attempted, and even if the harm is not actualised. Interfering with the course by placing obstacles and/or tampering with course markings is considered a severe threat to the safety of competitors/athletes. Consequently, such actions will be promptly reported to the judicial authorities.

6.5. Behaviour of Athletes and Competitors
Subject to the regulations outlined by the Italian Cycling Federation (FCI) for the Bike Marathon, the conduct of athletes and competitors in Bike Festival sporting events will be governed by the specific regulations established by the organiser for each individual competition.
Additionally, the Federal Technical Regulations issued by the Italian Cycling Federation (FCI), as explicitly referenced in the regulations, shall apply.

In addition to the event regulations, competitors are required to follow the Italian Highway Code, especially on sections of the route that are open to traffic. Competitors should familiarise themselves with these rules in advance.

Runners will demonstrate sportsmanship at every opportunity and give way to faster runners, without stopping them from overtaking. If for any reason a competitor leaves the course, they must re-enter at the exact same point. If the organiser believes that a runner has gained an advantage, they will be disqualified.

Runners must respect nature by taking care not to soil areas along the route.

For races other than the XCM Bike Marathon, the use of mobile phones, transceivers, and/or devices producing/reproducing sound and images, whether equipped with earphones or not, is permitted solely for the purpose of route verification.

“Micro-cameras” must be mounted in such a way that they do not compromise the safety of athletes and must only be attached to bicycles or helmet faceplates.

In general, participants in individual sporting events undertake to exhibit proper and respectful conduct, refraining from infringing upon the rights of others in any manner. Participation is unconditional, and no compensation will be sought from the organiser, except for specific agreements. All travel, accommodation and other expenses will be borne by the participants. In the event of Festival and/or individual event cancellations, participants are not entitled to reimbursement or compensation. With regard to offences related to sporting misconduct and fraudulent activities that involve violent and dangerous actions jeopardising the safety of other competitors and individuals, even if attempted, the principle of “absolute liability” is applied.

Consequently, such conduct observed during events may be attributed to registered members in all instances directly or indirectly connected to them. This includes situations involving third parties who are external but are associated with the registered member. Without prejudice to the federal regulations for the Bike Marathon, if an athlete/competitor is disqualified, the immediately subsequent athlete/competitor will inherit the rights and entitlements of the disqualified individual. This process will continue consecutively for other athletes/competitors, depending on the organiser's discretion regarding the timing and method of individual events.

Article 7 - OFFICIAL FESTIVAL LOGO
The Festival's official logo is the one contained in Trademark Registration No. 018926742. It is the exclusive property of Garda Dolomiti Azienda per il Turismo S.p.A. Any use of the logo or trademark must be made in advance by the latter.

Article 8 - GENERAL DATA PROCESSING
Personal data is processed in accordance with the GDPR and the Italian transposition legislation. The privacy policy can be downloaded here: bikefestivalriva.com/en/privacy

APT retains the authority to capture, film, and broadcast Festival stages through television, audiovisual, photographic, and recording means. By signing the release form provided with the competition entry application/entry pass release, each participant explicitly consents to such photography, recordings, and filming. This grants the right to use their image rights related to their public participation and presence at the Festival, encompassing commercial and promotional/advertising purposes without time or space constraints. In addition, the organiser reserves the right to use the captured footage for a photo book associated with the Festival and for publication on websites, web radio, web TV, and social networks in any manner.

The organiser reserves the right to link the Festival and/or its web, television, and/or radio broadcast with one or more promotional and advertising initiatives, encompassing sponsorship, merchandising, patronage, and telepromotions, without participants having any claim whatsoever.

By participating in the Festival, participants consent to bestow upon the Organiser, free of charge, the right to use their image for the specified promotional and publicity initiatives, commencing from the participation date and with no time limit.

Participation in the Festival implies full understanding and compliance with these regulations.

The organiser is covered by RCT Policy No. 2022/03/2474861, taken out with REALE MUTUA ASSICURAZIONI.
